Summary

Intuitive's Q3 2026 operating results are the strongest in several quarters, with revenue up 22 percent to $3.05 billion and da Vinci procedures up 14 percent, while the headline GAAP decline comes entirely from a one-time $450 million antitrust settlement charge. The stock is still down about 19 percent over twelve months, which leaves room for the gap between reported GAAP earnings and underlying operations to close.

Variant view

The market has spent the past year treating Intuitive as a decelerating capital-equipment story with a legal overhang, and the shares sit at $443.85 versus a 52 week high of $592.85. The Q3 figures do not support the deceleration part: placements, installed base and utilization all accelerated, and the largest piece of the litigation overhang was converted from an open-ended 2027 trial into a fixed $450 million payment. The memo does not disagree that litigation risk remains, only that it is now smaller and better defined than the price implies.

Evidence

From the Q3 2026 press release filed as Exhibit 99.1 to the October 20, 2026 8-K: revenue of $3.05 billion, up 22 percent from $2.51 billion a year earlier, driven by procedure volume, higher operating lease revenue and a larger installed base. Instruments and accessories, the recurring piece, rose 18 percent to $1.80 billion.

The 10-Q filed October 21, 2026 reports approximately 906,000 da Vinci procedures in the quarter, growth of 14 percent, and approximately 49,700 Ion procedures, growth of 31 percent. Utilization, measured as procedures per system per year, rose 2 percent against Q3 2025, so the installed base growth is not diluting usage.

Placements accelerated: 546 da Vinci systems in Q3 2026 against 427 a year earlier, an increase of 28 percent, with 315 of them da Vinci 5 units versus 240. Installed base reached 12,094 systems, up 12 percent. Systems revenue was $769 million against $590 million.

Margins improved while GAAP profit fell. The 10-Q shows gross profit at 68.4 percent of revenue versus 66.4 percent. GAAP operating income fell 22 percent to $592.6 million, but that line includes the $450 million antitrust settlement charge. Non-GAAP income from operations was $1.27 billion against $976 million, per the earnings release.

Capital allocation turned aggressive. The company repurchased 7.8 million shares for $2.94 billion in the quarter. Cash, equivalents and investments fell to $6.80 billion from $9.03 billion at December 31, 2025, mostly on buybacks, an acquisition and capex. That is a real drawdown of the balance sheet cushion, done at prices below the 52 week high.

The settlement is specific. Per the 10-Q legal note, in October 2026 Intuitive and the class plaintiffs in In re: da Vinci Surgical Robot Antitrust Litigation agreed to a one-time $450 million payment plus injunctive relief, removing a trial that had been scheduled for September 14, 2027. Approval by the Court is still pending.

Bear case

The litigation is not finished. The same 10-Q discloses that on August 13, 2026 the Ninth Circuit reversed the district court judgment in the Surgical Instrument Service matter and remanded it, with Intuitive's en banc petition filed September 29, 2026, and the company states it cannot make a reasonable estimate of loss. A separate Restore Robotics antitrust complaint is pending in Florida. The agreed injunctive relief in the class settlement could open the EndoWrist service and repair aftermarket, which is where instrument margin lives. Add the tariff and supply language in the filing, a cash balance down $2.23 billion in nine months, and $216 million of quarterly share-based compensation that non-GAAP figures exclude, and the bull case depends on a multiple that has already compressed for reasons that may be durable.

What would change my mind

First, a quarter in which da Vinci procedure growth drops into single digits or utilization turns negative, which would mean the installed base is being placed faster than it is being used. Second, an adverse outcome or a sizable new accrual in the Surgical Instrument Service remand, or court rejection of the $450 million class settlement, either of which would reopen the aftermarket question the settlement was meant to close.
